Apple Appeals Ban on Importing Watches

Apple is appealing a decision to ban imports of its watches based on a complaint from medical monitoring technology company Masimo. The tech giant has filed an emergency request for the US Court of Appeals for the Federal Circuit to halt the ban. The ban is related to a dispute over the incorporation of pulse oximetry technology into the popular Apple Watch. The US International Trade Commission’s order bars the imports and sales of Apple Watches that use this technology. The ban does not affect the Apple Watch SE. Masimo has accused Apple of hiring away its employees and stealing its technology. Apple has appealed the ban to the US Court of Appeals for the Federal Circuit and is taking measures to return its watches to customers as soon as possible. The ITC decision has become final, and Apple has generally chosen to live with the ITC order rather than settle. Apple has paused sales of its Series 9 and Ultra 2 smartwatches but they remain available from other retailers. The ban does not affect previously sold watches. Apple’s wearables, home, and accessory business brought in $8.28 billion in revenue during the third quarter of 2023.
