PTI regains ‘bat’ as Peshawar High Court ruling favors the party

The Peshawar High Court has suspended an order of the Election Commission of Pakistan (ECP) that declared the former ruling party’s intra-party polls ‘void’ and revoked its electoral symbol. Justice Kamran Hayat Miankhel pronounced a short order on a petition jointly filed by PTI Chairman Barrister Gohar Ali and six other leaders, requesting the court to declare the ECP’s December 22 verdict without jurisdiction. The court also directed the ECP to restore the election symbol of PTI and publish the certificate of PTI’s intra-party polls on its website. The PTI hailed the decision as a historical one and expressed confidence that the people of the country would bring the most peaceful and unprecedented revolution through their vote on February 8. The court proceedings saw senior lawyers arguing for the petitioners and the federal and Khyber Pakhtunkhwa governments being represented. The lead lawyer for PTI argued that the ECP had no jurisdiction to declare the party’s intra-party elections illegal and to issue show cause notices. The PTI Chairman and the lead lawyer of PTI lauded the PHC, calling the court’s order of immense importance and stating that the ECP has acted like an adversary instead of a neutral judge.
