Pakistan’s Supreme Judicial Council takes action, serves show-cause notice to SC judge Mazahar Ali Naqvi

The Supreme Judicial Council (SJC) has issued a show-cause notice to Supreme Court Justice Mazahar Ali Naqvi in response to 10 complaints against him. The council has given the judge two weeks to submit a reply. The SJC, which includes Chief Justice of Pakistan Qazi Faez Isa, met to address 29 complaints in total. Out of these, 19 were rejected, and the remaining complaints were brought to the attention of the judges involved and the legal heirs of deceased judges. The council has cautioned the lawyers who filed frivolous complaints. The SJC has decided to issue show-cause notices to Justice Naqvi in response to the majority’s decision, while the minority members requested more time to consider the complaints. In May, the Public Accounts Committee directed authorities to submit details of Justice Naqvi’s assets as part of an investigation into allegations of keeping assets beyond means. The SJC has other pending references against Justice Naqvi accusing him of misconduct and misuse of authority. One complaint also mentioned audio clips, including one allegedly featuring a conversation between the judge and former Punjab chief minister Chaudhry Parvez Elahi. In March, a reference was filed against Justice Naqvi after his name was linked to an alleged audio leak. The reference alleged that Justice Naqvi violated the code of conduct when granting bail to an accused person who changed his lawyer. The case reached the Supreme Court, and a reference was initiated in the SJC on charges of misconduct. The PML-N, the party that filed the reference, argued that such conduct sets a bad example for other judges. The SJC has dismissed a complaint filed against a Supreme Court judge who is a member of the council. Another complaint filed by Amna Malik against Justice Masood will be reviewed once the necessary supporting material is provided. The council has also discussed the establishment of a dedicated secretariat for the council with a full-time secretary and staff. The registrar of the Supreme Court will prepare a working paper on this matter for consideration.
