US District Judge William Shubb has ruled that a California law requiring social media companies to disclose their content moderation practices is not unjustified or overly burdensome. The law, signed last year by Governor Gavin Newsom, mandates that companies submit twice-yearly reports on how they address hate speech, misinformation, and other objectionable content. This ruling comes after Elon Musk’s X, formerly Twitter, lost a bid to block the law, arguing that it violates freedom of speech protections under the US Constitution. Despite X’s claims that the law interferes with their editorial judgement and forces them to remove constitutionally-protected speech, Judge Shubb denied their motion to temporarily suspend the law. X has faced backlash from advertisers and is also under investigation by the European Union for suspected breaches of the bloc’s Digital Services Act related to content regarding Hamas’s attacks on Israel.
