CJP Isa expresses concern over constitutional ‘encroachments’ and advocates for lifetime disqualification – Pakistan

The Chief Justice of Pakistan, Qazi Faez Isa, expressed concern about the changes made to the Constitution over the years and emphasized the importance of the original Constitution. This came during a Supreme Court hearing to determine the disqualification period for lawmakers. The larger bench, headed by the CJP, is addressing the debate on whether disqualified aspirants under Article 62(1)(f) of the Constitution could contest polls in light of the amendments in the Elections Act 2017. The legal conundrum arose due to conflicting judgments and amendments to the law. During the hearing, the lawyer for Jahangir Khan Tareen argued that the declaration of disqualification under civil law should not result in a lifetime ban. The CJP highlighted the need for logical reasoning and emphasized that the Constitution is for the people of Pakistan, not just for lawyers. The hearing will continue as the bench deliberates on the complex legal issues.
