Supreme Court’s bold and principled decision rejecting the “Trial of Civilians by Military Courts” has jolted and embarrassed Pakistan’s Establishment; they will now pressurize Chief Justice and other Hon. Justices to waeken this decision through appeal to a larger or Full Court. Ball is in the court of Chief Justice Qazi Faez Isa.
Chief Justice faces a complex situation. Nawaz Sharif has, according to sources in legal community, helped him all along in his career (when CJP Iftikahr Chaudhry elevated him directly as Chief Justice Baluchistan High Court in 2009) and Imran Khan Govt offended him by sending an unnecessary reference against him under pressure of Military Establishment. But Qazi Faez Isa is a good man, an educated liberal man; now as CJP he faces the question of his own legacy that will depends upon siding with constitution and people and justice. Will be force the Election Commission for an earliest possible election date? Will he grill the system for abusing constitution on the issue of elections? Will he help Establishment through a larger bench for appeal against the Supreme Court decision on Military Courts? Jury is out on all these issues!
