Supreme Court Issues Notices in Response to Plea Against Deportation

The National Action Plan (NAP) apex committee, chaired by Caretaker PM Anwaarul Haq Kakar, set a deadline for all foreign nationals living illegally in the country to leave voluntarily or face deportation during a meeting on October 3. Since the deadline expired, nearly 300,000 illegal Afghans have returned to their homeland via the Torkham and Chaman borders. The caretaker government’s authority to evict illegal foreign nationals was questioned, and the Supreme Court remarked that the deportation of Afghan nationals residing illegally in Pakistan is a matter of constitutional interpretation. Justice Ayesha Malik emphasized the rights of refugees under UN pacts and Pakistan’s obligation as a signatory. Justice Sardar Tariq sought guidance on whether illegal Afghan nationals who have been living in Pakistan for the last four decades should be allowed to remain. The Supreme Court issued notices to the federal government, apex committee, and foreign ministry and adjourned further hearing on the plea.
