CJP Qazi Faez Isa said the Supreme Court intends to wrap up proceedings on lifetime disqualification quickly to prevent confusion for returning officers. A seven-member larger bench, headed by the CJP, is addressing the issue as the February 8 general elections approach. The case centers around whether aspirants disqualified under Article 62(1)(f) of the Constitution can contest polls in light of amendments in the Elections Act 2017. The legal dilemma arose due to a 2018 Supreme Court judgment in the Samiullah Baloch case, which ruled that such ineligibility was for life. An amendment was later brought in the Elections Act 2017, specifying that the period of the electoral disqualification would be for five years, not for life. The issue of electoral disqualification recently arose in an election dispute case, and various parties presented their stances during the hearing. The AGP urged the court to review its previous ruling on lifetime disqualification, while other respondents were in favor of it. The CJP and other justices made observations and asked questions related to Article 62 and 63 of the Constitution, the implications of the amendment to the Election Act, and the concept of good character. The hearing is ongoing, and more updates will follow.
