Islamabad High Court declares NA-35 and NA-36 constituencies’ delimitation null and void

Islamabad: The Islamabad High Court has declared the delimitation of National Assembly constituencies NA 35 and NA 36 as null and void. The delimitation of constituency NA 35 in Kohat and NA 36 in Hangu and Kozai has been declared null and void, while the request against the delimitation of constituency NA 53 of Chaudhry Nisar has been rejected.

Chief Justice of Islamabad High Court Justice Aamer Farooq, while announcing the reserved decision, directed the Election Commission to conduct a fresh delimitation by hearing all parties.

The court, issuing a written decision, has said that the Election Commission should make a solid decision after hearing the stance of the petitioner.

Barrister Omar Ijaz Gilani had argued that according to the law, the population of all constituencies should be equal. The petitioner’s stance was that for example, the population of Kohat’s constituency is more than three lakh more than the population of Hangu’s constituency.

The petitioner’s stance was that the new delimitations by the Election Commission undermine the right of the area’s people to vote.

The court rejected the request against the delimitation of former Interior Minister Chaudhry Nisar’s constituency NA 53 and PP 10. The request against the delimitation of constituency NA 53 was filed by Sheikh Sajid ur Rehman.
