Imran Khan’s Toshakhana Sentence Suspended, but Detention to Continue

The Islamabad High Court (IHC) has suspended PTI Chairman Imran Khan’s three-year sentence in the Toshakhana case. However, Imran will remain detained at Attock Jail due to his involvement in another case related to a missing diplomatic document.

The Toshakhana case revolves around a cipher that reportedly contained a threat from the United States to remove Imran from power. Imran’s request for suspension of sentence in the Toshakhana case has been approved by Chief Justice Aamer Farooq and Justice Tariq Mehmood Jahan­giri. A detailed decision is yet to be provided.

Following the suspension of his sentence in the Toshakhana case, it is still unclear when Imran will be released from Attock Jail. The PTI has demanded Imran’s immediate release, stating that his arrest in any other case would be ill-intentioned and mala fide.

The Toshakhana case stemmed from the Election Commission of Pakistan (ECP) filing a case against Imran for concealing details of state gifts, resulting in his conviction and a three-year prison term. Imran had filed an appeal in the high court against his conviction, and the Supreme Court had acknowledged procedural defects in the case but awaited the IHC’s decision.

The PTI legal team has filed a fresh petition in the IHC to refrain from further arresting Imran in any case filed against him after August 5. The PTI lawyer has also demanded compensation for the days Imran was kept behind bars.

Though Imran’s sentence has been suspended, it does not affect his conviction status. The detailed verdict is awaited to determine whether the court has addressed Imran’s disqualification. Imran’s legal team may challenge the suspension of the sentence in the apex court.

The PML-N has expressed displeasure toward the outcome, claiming that Imran’s sentence has been suspended and not terminated. The party president has criticized the higher judiciary’s alleged prior knowledge of the verdict and expressed concern for the justice system.

Imran’s wife had previously raised concerns about his deteriorating health, prompting upgrades to his prison cell’s facilities. The Attock Jail authorities have submitted a report detailing the facilities provided to the former premier.

The Toshakhana case revolves around Imran’s alleged concealment of gifts received during his tenure as prime minister. The case led to Imran’s disqualification and subsequent legal issues.
